How Foreign Founders Can Access Government Information in Sanya: A Guide to the City's Business Environment Bureau
A practical overview of how foreign founders can request and obtain government information from the Sanya Business Environment Construction Bureau, including scope, channels, timelines, and fees.
Why Government Information Matters for Foreign Founders
When setting up or running a company in China, access to official government information is essential for compliance, planning, and understanding local regulations. The Sanya Business Environment Construction Bureau (三亚市营商环境建设局) has published a guide explaining how the public—including foreign founders—can obtain government information. This article summarizes the key points from that guide, focusing on what foreign founders need to know.
What Information Is Available
The Bureau discloses information that affects the rights and interests of citizens, legal persons, and other organizations; information that the public needs to know or participate in; information about the Bureau's structure, functions, and procedures; and other information required by laws and regulations. Key categories include:
- Normative documents issued by the Bureau
- The Bureau's functions, organizational structure, office address, office hours, contact details, and names of responsible persons
- National economic and social development statistics related to the Bureau
- Annual government information disclosure reports, important meetings, key work, and personnel appointments and removals
- Budget and final accounts information
- Interpretations of policies on hot livelihood topics
- Other information that should be proactively disclosed under laws, regulations, rules, and national provisions
The information is organized into four primary categories: government information disclosure guide, government information disclosure system, statutory proactive disclosure content, and government information disclosure annual report. There are also 12 secondary categories, including agency overview, leadership information, policy documents, plans and planning, financial information, policy interpretation, public notices, government affairs work, "Yilu Kuaiban" policy Q&A, solicitation surveys, feedback on solicitation results, and departmental projects.
How Information Is Disclosed
Proactively disclosed information is published within 20 working days from the date the information is formed or changed, unless laws or regulations specify otherwise. The Bureau uses various channels, including press conferences, the "Sanya Business Environment" WeChat official account, the Bureau's information disclosure column, radio and television, and newspapers. Information can also be accessed at the Sanya Library, Archives, and the Municipal Government Service Center.
Requesting Information That Is Not Proactively Disclosed
Citizens, legal persons, or other organizations may apply to obtain government information based on special needs related to production, life, or scientific research. According to the regulations, the Bureau generally provides existing information and does not need to compile, process, or recreate information.
Applications can be submitted by:
- Postal mail: Send to the Business Environment Construction Bureau, Chengyun Building, No. 352 Yingbin Road, Jiyang District, Sanya City, Postal Code: 572000. Mark "Government Information Disclosure" on the lower left corner of the envelope.
- Online system: Fill out and submit the application form in the "Application for Disclosure" section on the Bureau's information disclosure page. After successful submission, keep the electronic number for tracking the application status.
Processing Timelines and Responses
The Bureau will respond immediately if possible. If not, it will provide a written response within 20 working days from receipt of the application. Possible responses include:
- If the information can be disclosed, the Bureau will provide it or inform the applicant of the manner, channel, and time to obtain it.
- If the information does not belong to the Bureau or is not found after searching, the Bureau will inform the applicant and explain why. If the responsible agency can be identified, the Bureau will provide its name and contact information.
- If the application content is unclear, the Bureau will provide guidance and explanation and notify the applicant within 7 working days to make corrections, specifying what needs to be corrected and a reasonable correction period. The response period starts from the date the corrected application is received. If the applicant fails to correct without justified reason, the application is considered abandoned.
- If the applicant repeatedly requests the same information that has already been answered, the Bureau will inform the applicant that it will not process the request again.
- If the requested information involves business registration, real estate registration, or other information with special access rules under laws or administrative regulations, the Bureau will inform the applicant to follow those provisions.
Information Processing Fees
According to the relevant notice on government information disclosure information processing fees, the Bureau may charge fees for applications that exceed a certain quantity or frequency. If fees are charged, the Bureau will issue a fee notice within the processing period, explaining the basis, standard, amount, and payment method. The applicant must pay within 20 working days from the day after receiving the notice; otherwise, the application is considered abandoned.
